Purchasing a home can be a very confusing process. The staff at W. Mack Rice, P.A., Attorney at Law has the experience necessary to guide you through the entire process of purchasing your home. Once we have been engaged to represent a buyer and/or seller in a real estate transaction, we open a file and the work begins. We are available throughout all stages of the process to answer any questions that you may have. In addition to answering your questions, our duties include performing a title examination of the property and conducting the closing. We perform a title examination to ensure that the buyer takes title to the property free and clear of all liens. A closing is performed to finalize the matter. This generally involves signing all documents necessary to transfer title or ownership from the seller to the buyer, and involves the signing of loan documents furnished by the lender for the benefit of the buyer. A careful examination of the documents is made to ensure accuracy and compliance with the contract, and an explanation of each document is provided so the buyer understands what he/she is signing and why. As a closing agency we must comply with all state and federal laws pertaining to real estate closings, and we must strictly adhere to the written instructions of the buyer’s lender.

Upon conclusion of a closing, we must update the title examination and record the deed on behalf of the buyer for the transfer of ownership and record the deed of trust on behalf of the lender to ensure a first lien position on the property. Post-closing matters entail disbursing checks to all parties involved in the transaction, overnighting a payoff, if any, to the seller’s mortgage company, and submitting a final title opinion to the title company so that the title interests held by the buyer and lender are properly insured.
